Instructions on the complaints of the foreign merchants

1. The executive scope:According to the regulation of Interim Procedures of the Complaints of the Foreign-invested Enterprises issued by Ministry of Commerce, foreign-invested enterprises and the investors in the administrative region of our city (hereinafter referred to as complainant), who think that their legal interest has been encroached by the administrative act of the administrative institutes and submit for coordinate solution to the complaint accepting institutions, or reflect, raise suggestions, advice or requests, the complaint accepting institutions for foreign enterprises of Shenyang and districts (counties) should accept and give coordinate solution.

2. Conditions of the acceptance of the complaints:The complaints with specific targets and requests; The complaints with qualified right of principal; The complaints with specific facts, reason and enclosed with relevant proof; The complaints in the range of the items regulated by our country.

3. The complaints not to be handled:Has already entered or finished the judicial procedure, procedure of administrative review and arbitration procedure; The one has already accepted by discipline inspection department, supervisory department and complaint divisions; The one has already accepted by complaint acceptance institutes; The disputes between the investors or irrelevant to administrative acts; The one cannot meet the condition of the complaints.

4. Procedure of the handle of complaints:

(1) Materials needed for the investigation and complaints.After the acceptance of the complaints, the decision will be made after the investigation of the complaint acceptance institute; The complaint acceptance institute should inform the complainant if he/she needs to supplement the complaint materials.

(2) Registration of the complaint acceptance.The complaint acceptance institutes should make registration in time, fill in complaint acceptance registration form, mark the date of complaint acceptance and inform the complainant.

(3) Handling the complaint.According to different complaints and the principal part being complained, the complaint acceptance institutes should handle, transfer, assign, report and coordinate the issues.

(4) Follow up the result of the complaints.After the handling of the complaints, the acceptance institute should inform the result to the complainant and call back to the complainant at fixed period and carry out satisfactory survey.
